- Section 106 of the National Historic Preservation Act requires federal agencies to "take into account the effects" of their undertakings-which may include licensing, funding, or permitting of activities carried out by private parties as well as activities actually performed by agency personnel-on historic properties. Historic properties are defined as sites, districts, structures, or objects that are on or elegible for inclusion in the National Register of Historic Places.
