- This document describes how important it is to the Native Hawaiian people to protect the burial sites of their ancestors and the impact that modern public and private construction and development is having on the Hawaiian culture due to the desecration of burial sites as a result of new construction. Since State and County governments have traditionally favored development at the expense of the Hawaiian culture and is biased toward modern-day development, academic curiosity, and study, and since Hawaii law regarding the disinterring of burials protects cemeteries only and not the older Native Hawaiian burial sites and does not take into consideration the cultural imperative of a native people, conflict is resulting between the Native Hawaiians and developers since the Native Hawaiians will not tolerate burial desecration in this day and age.
