Summary:
In an effort to build six 1.8-meter outrigger telescopes alongside the Keck Observatory's two 10-meter domes, the National Aeronautics Space Administration (NASA) faced a setback as a result of a lawsuit that was filed by the Office of Hawaiian Affairs (OHA) against NASA and the University of Hawaii. The terms of the suit requested that NASA be required to perform an Environmental Impact Statement (EIS) prior to building the telescopes. While it was ruled that the lawsuit had merit as a result of an Environmental Assessment that failed to adequately assess the cumulative environmental impact that further construction might have on the ecosystem and possible historical remains that encompassed the site of the project, the court refused to rule as to whether NASA should be required to perform a full EIS before constructing the outrigger telescopes. However, in spite of the ruling that would have allowed for NASA to proceed with obtaining building permits, NASA decided to regroup and evaluate the judgment in detail and set no timetable regarding the next course of action.
