Summary:
A group of sheep hunters on the island of Hawaii, Sportsmen of Hawaii (SOH), attempted to overturn a federal court's order in an effort to prevent the State of Hawaii from eradicating the sheep on the slopes of Mauna Kea. The group argued that without the sheep grazing on the grass on the upper slopes, that the grass would grow uncontrollably and pose a fire risk. The group felt that this would result in greater habitat loss and be more of a danger to the endangered Palila bird (Loxioides bailleui) than the sheep were by grazing on the mamane trees that provide food, shelter, and nesting sites for the Palila. However, the appeal was dismissed by the 9th Circuit Court of Appeals in San Francisco sighting the SOH's lack of jurisdiction.
